I have to foreclose on my home. Advice and steps involved?

My wife and I own a townhouse in Orlando, FL. My job in Orlando was ending due to the recession and the job outlook looked grim. I took a job in Phoenix, AZ while my wife quit her job and is having some trouble finding one in Phoenix. We have a professional leasing company find tenants for our town house while we rented a condo in Phoenix. Since my wife isn’t working, we are having difficulties paying our rent plus part of the mortgage (the rent doesn’t cover all of the mortgage plus our HOA fees each month). We thought about a short sale, but then was told that since we are not the primary residents in our townhouse, then a short sale wasn’t an option, which leads us to foreclosure. I don’t really want to do it, but I have lost over 100k in our home in the last 2 years and it’s financially draining on us. What are the steps in foreclosing a home? Do we just stop making payments? Do we advise our lending company first? I always hear of people just walking away from there homes, but there is got to be more to it than that. Any advice would be great.

Is a condo in downtown Salt Lake City a good investment?

Hi,
I’m a 23 year old female. I’ve been living abroad for the past few years and just got back to Utah (my home state). I’m staying with the parents temporarily while I decide what to do next. I know I want to move to downtown SLC, since most everyone my age lives there. But renting seems absolutely ridiculous. I’ve been able to find some pretty cheap condos and small homes for sale in the area. I think a condo would be nice b/c you can get a pool, clubhouse, and the HOA fees will pay for all property maintenance. Yet, I’ve read some pretty scary articles about how bad an investment a condo is…

So there a few factors to consider in my decision. I will be living in the property for at least a few years and most likely have a 30 yr. mortgage. I intend the property to be a starting home, and will hopefully trade up in a few years. I like living w/ roommates and would be renting out both while I live in the property and after the fact. At some point in time, I will want to sell the property. The condos are more centrally located downtown, whereas the homes are on the outskirts.

Any input from those who have experience in the subject would be greatly appreciated. Thank you :)

Quebec Joint Mortgage – What are the laws between my GF and I?

I am currently involved in the purchase of a new condo in Quebec with my GF. We both have very different financial situations but have come to an agreement on our mortgage budget etc. The thing I’m wondering is if there are laws to protect each of our initial investments. By this I mean, if we ever sell or split up and sell, by law, do we each get our initial down-payments back. And what happens in the event of profit on a sale? If I put a 40% down-payment and she puts only 4%, does that mean I would get 86% of the profits? (50% +36% difference between us). Do laws exist to protect me or do I have to see a lawyer or notary to write up a document for us?

you need no atty or notary…….you can hire one but it is not needed. YOU do need
an agreement between you two–that says "I am investing in this house, x dollars
and I expect x + ? [fiil in] back under the following circumstances……….

IT is that simple. IF what you put down is not contradicted by her, then you have
an agreement and when the condo has a purchase contract on it, you would take that agreement to a TITLE company [or someone who handles the closing papers for the condo] and they would
do the math and REMIT to each of you what your contract states you get.

YOU may ask for anything; there is no law covering what you can get.
There are laws for transfer fees and taxes; whether due at closing or at the end/beginning
of the next year……..

Can my landlord hire a real estate agent to show the condo I rent in GA?

I’m at the end of a 1 year lease and I live in GA, USA. My landlord wants to show the condo for sale while I’m living here, but he won’t be the one showing the apartment–a real estate agent will be showing the condo. In Georgia he does not need to give notice that he is entering the condo, but does that transfer to a real estate agent as well?

Check out state law, LL/tenant, notice and entry.
That’s ODD if GA doesn’t require notice. The majority of states require advance notice to tenant, not permission of tenant.
A real estate agent is an agent of the owner or LL, and LL may generally transfer to that agent their same rights. But sometimes there are limitations.
Do you have a current lease now? READ it, as it may require advance notice even if GA does not.
If you are renewing lease, get some protections for yourself in new lease, requiring 24 hours notice, agent must be bonded, etc.

I’m searching for a 2/2 condo or townhouse (preferrably foreclosure or SHORTsale) in these areas. I’ve been wasting time on a shortsale for almost a year now & nothing is closer than it was 11 months ago. I’m looking for an agent who specializes in condo or townhouse sales and knows how to make things move at a rapid pace, or at least try. My agents do absolutely nothing & are just waiting for a payday that’s never gonna happen. I’ve tried other agents in the interim but to no avail.
I want nothing more than 90k, HOA fees no more than $300, FHA or HomePath mortgages, & 1st or 2nd flrs only.

If someone knows a really good realtor who can make me a homeowner asap, please provide their info or website. Thanks

Can I buy a condo from owner,skipping agent and realtor?

I find this owner on caigslist, she already has an agent working for her, it’s a short sale condo. So can I just buy it directly from the owner and bank, skipping agent? In this way, I could pay less, right? Please give me some ideas.

There is no law requiring an agent in a real estate sale. If she already has an agent, the contract she signed probably obligates her to pay the agent’s commission regardless of how the sale is completed. The BANK has already ASSUMED the agents commission in the amount they will accept.

50 years ago we all thought that phones would still be all wired. We thought cars would fly and we had no idea about personal computers…so what makes you think we really know the future now.

There would have to be some pretty basic things change to prevent renting large homes. I can not imagine a time when some owners would would not want to rent out a family mansion so they could continue to own it- in times of personal hardship. But who really knows.
