How long after bankruptcy will it take for them to take my house?

I’m going to file bankruptcy and put my townhouse in it. I hate to do it but the value has dropped about $30k in 1 year! I owe $94k and it’s worth about $63k now! Section 8 has moved into our area and the crime keeps going up. There are 26 other townhouses for sale around here and starting at $52k. Most are foreclosures.

So my question is this. I am going to file bankruptcy next month and put the condo in it. How long do I have until they kick me out? Does anyone know how that works? I know they are backed up and I’ve heard stories where people stay up to 2 years! I don’t know if it’s different since it’s not foreclosure, but bankruptcy. I want to stay here for a few more months until I can find a new place.

You will have a few months. Here’s the process.

1. You file for BK. At this moment, all creditors must cease collection activity including repossessions and foreclosures.

2. 60 days later (more or less), you attend the meeting of creditors. You swear under oath the facts contained in your BK filing are true and complete. If a creditor shows up, you will be asked additional questions.

3. 60 days later (more or less), the disposition of your case will be closed (usually you’ll receive a discharge of debts — that’s good.)

4. Bank will continue its foreclosure process, and the foreclosure process might take weeks or months from this date.

5. Bank will either sell the house or take ownership.

6. You will be evicted.

Anyone know any good sites to find for sale houses?

Mobile homes (NOT TRAILORS!), condos, and town houses are acceptable too.
I am helping my aunt find a place to live and have already searched on comfree, remax, royal lepage and a few other sites.

It all depends on where she is looking. Usually you can search for the area she is looking and you will get several options of sites. Realtor.com is another decent option, though it is not linked in real time to the MLS (updates only 1x a day).

Another option is to look for a Realtor to help her, usually the buyer’s agents commission is paid by the seller so your aunts interests as the buyer would be protected with a buyer’s agency agreement in place and it would cost her nothing on top of the purchase.

Some Realtors even have email listings set up, where you can enter your search criteria and then sit back and let their site work for you, it usually sends an update every am. My site sends it at 3am and is linked real time to my regions MLS and my clients love it, because they never miss something coming on the market that fits their criteria. You should also make sure she has been pre-approved with a reputable lender, so you know you are looking in the right price range.

And Mobile homes generally are trailers, so I am guessing you may have meant modular? It can be difficult to get a mortgage for trailers and/or mobile homes.

I’m selling my condo and there is a pending assessment for repainting exterior of condos; there is no amount established yet just talks…should I tell buyer? What is best way to ensure deal goes thru?

Most likely, your buyer’s attorney will find out about it prior to closing. Once buyer knows about it, you will probably have to find out from the HOA what the assessment will be and negotiate with the buyer who pays what. Logically, the assessment would be due as of a certain date and the owner of record on that date would be responsible for payment. Obviously, if buyer knows about it (which again I think they will) they may be less inclined to purchase. I think you run the risk if you purposely neglect to disclose it to the buyer that you could still be held resonsble for a part or all of the assessment even after closing. Good luck!

First how much would your payment be per month if you had decent credit and a $200,000 house. Also why is it that some houses are listed at $5,000? Are they really that cheap? Are some forclosures for decent houses really $20,000? I really don’t get all this stuff if you want the best answer clear all this up for me. Thanks!

Some are as cheap as 20k.
The ones that are that cheap are in need of lots of work, top to bottom, not in livable condition, and will cost you about 100k+ to restore.
Better off buying "decent" and doing some remodeling or cosmetics.
as for your first question, $2,000 (ish) I’m looking to put down a good amount and borrow about 100k, after taxes/insurance, I’m looking at roughly $800-1,000 a month.So, about double for a 200k loan I’m guessing.
